Basque political prisoner in Montreal: Ivan Apaolaza Sancho

IVAN APAOLAZA SANCHO is a Basque political prisoner who, as of this coming June 20, will have been detained in Montreal’s Riviere-des-Prairies (RDP) prison for one year. He has lived in Canada for seven years, but has been declared ineligible for entry by the Canadian state, partially on the basis of evidence obtained by torture in Spain. In this exclusive interview, Ivan phoned No One Is Illegal Radio from his prison block at RDP, and shares his views about his detention, the evidence against him, his struggle for basic rights at RDP prison and more.

“Samosa politics”and apologies for the Komagata Maru incident of 1914

In 1914 a boatload of mainly Punjabi migrants from then-British India landed off the West Coast of Canada, and aimed to settle in BC as "British subjects". They were not even allowed to land on-shore, and with the use of the racist "Continuous Journey" provision, meant to restrict non-white migration to Canada, the migrants were forced to return to British-controlled India, where many were slaughtered in a one-sided skirmish with British imperial troops. In May 2008, 94 years later, the federal and provincial governments have offered formal apologies. For a critical view of the Komagata Maru apology, we speak with GURPREET SINGH who works with Radio India, and is a columnist for the South Asian Post and Surrey Now in British Columbia. Gurpreet criticizes the "samosa politics" of community gatekeepers, and asserts that the Komagata Maru incident of 1914 has very relevant lessons for migrant justice struggles today.

The International Migrants Alliance founding conference in Hong Kong

Later this month, the International Migrants Alliance (IMA) founding conference will take place in Hong Kong. The IMA comes together around the theme: "Migrants and refugees of the world: Unite to defend and fight for our rights! Struggle against imperialist attacks! Promote international solidarity!" We speak with RAMON BULTRON of the Asia-Pacific Mission for Migrants about the historic conference. Originally formed to fight for justice for Filipino migrants in the Asia-Pacific region, the Asia-Pacific Mission for Migrants now encompasses migrant workers -- both so-called illegal and legal -- from all over the Asia-Pacific region, including the Middle East. MARYLYNN POUCACHICE: Marylynn is a member of the Lac Barriere Algonquin Community, located 5 hours north of Montreal, and a spokesperson for the Customary Chief and Council. The community has been resisting the imposition of Department of Indian Affairs-imposed chiefs, as well as the occupation of their community by the Surete de Quebec (SQ). In this interview, Marylynn describes the ousting of the Customary Chief and Council of her community in early March, during an SQ raid. She also speaks about the struggle to teach Algonquin in Lac Barriere schools, the blockades against logging in La Verendrye Park, the failure by governments to implement the trilateral agreements of 1991, and more.

She currently works with the Indigenous People's Free Skool, the International Indigenous Youth Network and the Native 2010 Resistance. In January 2007, Canadian mining company Skye Resources instigated the forcible eviction of several Q'eqchi' indigenous communities in Guatemala. The evictions were violent, destructive and highly illegal. This is an account of a fight for ownership and livelihood in the face of staunch injustice. Mai à l'oeuvre!: Horaire des événements

Le 4ème festival annuel de célébration des cultures et résistances ouvrières:
Tout mur renversé devient un pont

Un festival qui célèbre les arts et la résistance de la classe ouvrière, pour faire tomber les murs qui divisent les victimes des injustices de la guerre, du racisme et du néolibéralisme.


Aujourd’hui, à Montréal, les immigrantEs et les migrantEs portent le poids de la mondialisation économique. Le cas de l’usine Lamour Hoisery est particulièrement éloquent : la compagnie a mis ses employéEs à la rue pour ensuite chercher à accroître ses profits en s’installant ailleurs. Un grand nombre de compagnie déménagent dans les pays d’où sont originaires ces mêmes travailleurs et travailleuses aujourd’hui sans emploi – au Bangladesh, en Inde ou en Chine, pour exploiter leurs frères et leurs sœurs. Les ouvrierEs de Lamour n’ont reçu ni indemnité ni justice. Ils et elles travaillaient dans des conditions qui rappellent le début du siècle, enferméEs dans l’usine la nuit, avec un syndicat pro-direction et sans pauses de dîner.

Des travailleurs et travailleuses agricoles migrantEs sont également forcéEs d’accepter de pitoyables conditions de travail : ils et elles doivent quitter le pays à chaque saison, subissent de la discrimination et sont parfois traitéEs comme des travailleurs et travailleuses engagéEs à long terme. Au bout du compte, ces personnes sont rendues invisibles. L’ironie de la situation réside dans le fait que Montréal est un atelier de misère qui repose sur le dos des migrantEs et des immigrantEs. Les vêtements que nous portons, la nourriture que nous mangeons, les taxis dans lesquels nous voyageons dépend d’un travail non reconnu.

Les murs de l’Apartheid en Afrique du Sud ont été grandement condamnés. Il semble par contre moins facile de reconnaître que les dynamiques d’oppression, d’exploitation, de ségrégation et de racisme institutionnalisé qui caractérisaient le régime d’Apartheid en Afrique du Sud sont aujourd’hui présentes à l’échelle mondiale. Le système actuel de migration et de travail divise les gens à l’aide de murs parfois tangibles, parfois intangibles, et maintient le système de pouvoir et d’exploitation.

Nous devons nous rappeler que la lutte pour la dignité va au-delà des intérêts des travailleurs et travailleuses : il s’agit d’une lutte pour la dignité de toutes et tous. En tant que travailleurs, travailleurs et personnes oppriméEs, la solidarité est l’arme dont nous disposons. C’est la solidarité qui a mis fin à l’Apartheid en Afrique du Sud ; c’est la solidarité qui viendra à bout de l’Apartheid en Palestine ; c’est la solidarité qui mettra un terme aux injustices et aux murs contre lesquels nous luttons ici.

« L’heure est venue de nous asseoir, à nouveau réuniEs, nous qui sommes si semblables dans nos différences, qui sommes nous et vous tous et toutes…Mais ceci n’est pas (pas encore, du moins) l’intention de cette lettre. De quoi s’agit-il, alors ? Any Wall Turned on Its Side Becomes a Bridge

A festival of working class art and resistance dedicated to bringing down the walls that divide those who face injustice from war, racism, and neoliberalism.


Today in Montreal immigrants and migrants face the brunt of economic
globalization. Whether it be in the textile factories such as Lamour
Hoisery which left its immigrant workforce in Montreal jobless to then
seek profits by moving their operations to the workers' homelands
of Bangledesh, India, and China and to exploit their brothers and sisters
there, leaving them here with no severance and no justice. They worked in
conditions reminiscent of the beginning of this century, locked in the
factory at night, with a pro-management union and no lunch breaks. These
are only a few examples of the conditions they faced.

We also see migrant farmworkers facing the gravest of work conditions:
they are made to leave each season, they face discrimination and are
sometimes treated like indentured labourers, and are ultimately made to be
invisible. The irony of this state of affairs is that this city is a
sweatshop resting on the backs of migrants and immigrants. The
clothes we wear, the food we eat, the taxis we take all depend on their
unrecognized labour.

The walls of Apartheid in South Africa were widely and comfortably
condemned – but what is more uncomfortable is to acknowledge that the
patterns of oppression, exploitation, segregation, and institutionalized
racism that characterized South Africa’s apartheid reign persist on a
global scale today. The current global migration and labour system works
to divide people through walls both tangible and intangible, and to
maintain that system of power and exploitation.

We must recall that their struggle for dignity is not just a struggle for
their own dignity, but for dignity for all. Solidarity is the weapon we as
working and oppressed people have. It is solidarity that brought down
apartheid in South Africa, and it is solidarity that will bring down
apartheid in Palestine, and that will bring down injustice and walls that
we struggle against here.

so similar in our differences who are us and all of you...But, well, this
is not (not yet anyway) the purpose of this letter. What is it then? Well,

Recently the Conservative government introduced a series of amendments to the Immigration and Refugee Protection Act (IRPA), buried in Bill C-50, a 136-page "budget implementation bill".

This fundamentally undemocratic move sneaks in critical changes to Canada's immigration policy without proposing any of those changes before Parliament. By making it a matter of confidence, the government forces Opposition parties to either accept them or call an election.

This series of amendments places more arbitrary power in the hands of
the Immigration Minister:
- Under the existing s. 11 of the IRPA, anyone who meets the already
stringent criteria to enter Canada as a worker, student, visitor, or
permanent resident, shall be granted that status. However, under the
proposed changes, despite meeting the criteria, the Minister will have
the discretion to arbitrarily reject an application.

- Sec. 25 currently says that the Minister "shall" examine a
Humanitarian and Compassionate application - this is changed to "shall"
examine the H&C application if the applicant is in Canada, but only
"may" examine the application if the applicant is outside Canada.
Although the government claims will have no impact on family
reunification, in practice it will have a serious impact on family
reunification as H&C applications are one of the most frequent avenues
for family reunification (for example separated refugee children).

- Proposed s. 87.3 of the Act will allow the Minister to issue
"instructions" setting quotas on the "category" of person that can enter
Canada - including quotas based on country of origin. This unprecedented
modification of IRPA would risk putting in place implicit equivalents to
the Chinese Exclusion Act of 1923, the Order in Council of 1911
prohibiting the landing of " any immigrant belonging to the Negro race",
that of 1923 excluding "any immigrant of any Asiatic race", or the "None
is too many" rule applied to fleeing Nazi-occupied Europe during the
Second World War.

- Ministerial power in deciding the order in which new applications are
processed, regardless of when they were filed. This means prioritizing
immigration applicants based on their ability to fulfill the needs of
the Canadian job market, "whether it's people to wash dishes and make
sandwiches, or whether it's the highly skilled engineers", as stated by
Minister Diane Finley. This is a profoundly dehumanizing and racist
conception of immigrants as disposable commodities.

- New sections 87.3 (4) and (5) of the IRPA would allow the Minister to
simply hold on to, return, or throw out a visa application and deny any
opportunity to review that decision in Court. This precedent is truly
alarming, especially in the context of a deeply flawed appeals process,
including the existing lack of implementation of a Refugee Appeal
Division, despite being provided for under IRPA.

The Conservatives argue that these changes are necessary to "modernize"
the immigration system and reduce the existing backlog. However, the
true objective is clear from Finance Minister Jim Flaherty's comments
that the government seeks a "competitive immigration system which will
quickly process skilled immigrants who can make an immediate
contribution to the economy."

The major lobby behind these changes comes from employers' organizations
and business lobbies. Indeed, Bill C-50 is being praised primarily by
business associations. Philip Hochstein, president of the Independent
Contractors and Businesses Association of British Columbia, has stated
that the government is moving in the right direction by focusing on
Canada's economic needs, "We need strong, young, willing workers to
come, much like the people who built this country."

Mr. Hochstein seems to forget the historical exploitation of immigrant
workers, the most well-known example of which is the Chinese railway
workers. The estimated 17,000 Chinese workers who came to Canada from
1881-1884 were met with dangerous working conditions and discrimination
upon their arrival. Chinese workers earned $1 a day, and it is estimated
that anywhere from 1500-2500 Chinese migrants died during the
construction of the railway. As soon as this dangerous work was
completed, the message was clear: Chinese people were no longer welcome.

These proposed legislative changes come in the context of a global
capitalist and nationalist reinforcement of labour flexibility as the
guiding principle of immigration policy, where migrants are only as
valuable as their labour. It is clear that the priorities will be
relatively wealthy people applying under the skilled worker program and
investor classes, as well as increasingly vulnerable temporary migrant
workers. Immigration policy will serve the needs of Canadian industry by
regulating migration and providing a flexible labour pool rather than
upholding the dignity of migrants.

These changes are directly in line with Canada's commitment to the
Security and Prosperity Partnership, which lays out the need for a rapid
expansion of both "low-skill" temporary guest worker programs and
"high-skill" professionals. In Canada today, the number of people
admitted each year on temporary worker visas is greater than the number
admitted as permanent residents. We must reject temporary migrant worker
programs of indentured servitude and call for the unconditional right of
migrant workers to permanent residency and labour rights equal to those
of citizens.

At the same time, such changes comes at the deliberate expense of
refugees, non-status migrants, or those seeking family reunification-
who are seen as increasingly 'undesirable' and potential security
threats in light of repressive post 9/11 controls. Decisions such as the
$101 million arming of Canadian border guards; the establishment of
Canadian Border Services Agency as an enforcement division in processing
refugee claims that sends the message that refugee claimants are a
threat to public safety; the ongoing unjust use of Security Certificates
against non-citizens; the implementation of the Safe Third Country
Agreement between the Canada and US which has drastically reduced the
number of asylum seekers able to make a claim in Canada; and increasing
rates of deportation to over 13,000 a year from Canada have all
perpetuated a racist, anti-poor, and anti-migrant agenda.

This agenda is normalized due to the heightened racialized national
identity of Canada that continuously places racialized immigrants
(although not white immigrants) as 'Outsiders' to the Canadian nation.
For example, much of the opposition to this Bill has challenged the
secretive process behind the bill, while still accepting the norm that
"Canada should be able to select its preferred immigrants", thus feeding
into the commodification of migrants and the assertion of Canada's
sovereign and racist right to select who it allows to remain, as
reminiscent through the Chinese Exclusion Act, Japanese-Canadian
internment, and Komagatamaru incident. Therefore although nothing new,
in the post 9/11 climate, we are witnessing an escalation of attacks
against 'immigrants'- the eternally hyphenated citizens- for example
through the reasonable accommodation' hearings, the wearing of the hijab
and turban, the phenomenon of "nippertipping" against Asian-Canadians,
and many more. The constant questioning of immigrants (although most are
long-time citizens) "ability to integrate", their "suspicious
behaviours", their "overburdening of the system", and their "Third World
traditions" reveals an incredibly shallow multiculturalism.

This mutual reinforcement of corporate and state interests - cheap
labour and national identity, respectively - evident in the
prioritization of labour market needs within the global War on Terror,
is legitimized not only by recourse to colonial and racist discourse but
also by the constant cultivation of fear in the hearts and minds of
citizens. The production of migrants as disposable commodities goes in
tandem with their construction as the dangerous "Other" or "The Enemy
Within" as the threat they pose can be tamed through a process of
commodification and the withholding of citizenship rights as a mechanism
of social control. Fear of the "dangerous Other" thus underwrites the
production of exclusivist nationalist identity (and therefore support
for the state) while fear of the "commodifiable Other" (as "stealing"
employment and eroding the social system) produces fearful and
disciplined citizens vulnerable to increasing corporate exploitation and
state repression.

Therefore, the general message to poor and working people of colour and
their families- the overwhelming majority of migrants from the Global
South- is that they need not apply as permanent residents unless they
are willing to come as temporary workers in exploitative jobs and whose
status will be legally reinforced as 'non-Canadians'. This is
particularly revolting in a context where the Canadian government and
Canadian corporations actively participate in the creation and
reinforcement of a system of global displacement of migrants and
refugees who are fleeing poverty, persecution, war and corporate
exploitation of their lands.

In light of this reality, we call for an end to deportation and
detentions and a comprehensive, transparent, inclusive and ongoing
regularization program that is equitable and accessible to all persons
living without permanent residency in Canada to ensure free migration
and full rights for all those who seek them. We also call for the
abolition of agreements such as NAFTA and the SPP, which are making
Canadian borders increasingly open to capital and those who represent
capital, while at the same time restricting the movement of those who
have been displaced by these very same neoliberal policies.

At a most basic level, we must also challenge the notion that some
migrants are more worthy than others; we believe that freedom of
movement is a fundamental human right and we struggle for a world in
which no one is forced to migrate against their will and where people
can move freely in order to live and flourish in justice and dignity.

Political Prisoner Day: Ivan Apaolaza Sancho still in jail
Update from the Freedom for Ivan Committee

Thursday, 17 April, is political prisoner's day. In Montreal, Ivan Apaolaza Sancho - a 36 year old Basque refugee claimant and political prisoner - has been in detention for over ten months.

Ivan is accused of having been a member of the ETA (an armed nationalist
Basque organization); an accusation that he denies. He has been detained at
Rivière des prairies Detention Centre since June 2007 and faces deportation
solely on the basis of accusations made by the Spanish state; no actual
evidence to support the allegations has been presented. Moreover, the
allegations themselves seem to come from a confession obtained under torture
(see below). If the Immigration and Refugee Board (IRB) Commissioner accepts
those allegations, Ivan faces deportation to Spain where he expects further
arbitrary detention and possible torture.

Ivan is one of hundreds of Basque political prisoners, held at the behest of
the Spanish state, often with the complicity of other states like Canada.
For centuries, the Spanish state has inflicted intense and cruel repression
on the Basque left-sovereignist movement (which enjoys broad support in
Basque society). Today, following in Franco's footsteps, the state continues
to use political repression as it attempts to dismantle the Basque
movement's base of social support. Of the 18,721 people arrested in Basque
country for political reasons between 1977 and 2002, 9200 people served jail
time, 5300 people reported having been tortured, and 9 people were murdered
during police interrogations.

On 24 March, the newly formed Freedom for Ivan committee organized a press
conference in Montreal to publish evidence indicating that all of the
allegations against Ivan originate from the "confession" a Basque woman made
under torture while she was held incommunicado by Spanish police. Ivan's
committee and lawyers called on Stockwell Day to immediately release Ivan
and cease Canadian complicity in torture.

The following day, Ivan's lawyers argued in an IRB hearing that the case
against Ivan should be thrown out for lack of evidence and because there are
reasonable grounds to believe that the allegations are based on information
obtained under torture, which is inadmissable under Canadian law. French
legal expert Didier Rouget testified that Canada could also be breaking
international law if it deported Ivan on that basis. The hearing will resume
on 25 April.

In the meantime, Ivan underwent another routine detention review. Just two
days before Political Prisoner day, the IRB Commissioner had another
opportunity to cease participating in torture and repression - but refused.

HOW YOU CAN SUPPORT FREEDOM FOR IVAN

At this point, Ivan and his supporters are asking organizations to:

1) Endorse the campaign demands (above).

2) Write a statement of support for Ivan in which we also encourage you to
speak to the larger political issues behind his situation (Ivan would like
this campaign to be explicitly political and to clearly denounce the actions
of the Spanish authorities).

3) Write and if possible gather letters of support from individuals and
organizations for the purpose of pressuring the Minister of Immigration and
Minister of Public Safety to agree to our demands. (Letter writing guide

5) Spread information about Ivan's case to your networks.

Journée des prisonniers politiques: Ivan Apaolaza Sancho toujours en prison
Mise à jour du comité Liberté pour Ivan

Jeudi 17 Avril commémore la Journée pour les prisonniers politiques. À Montréal, Ivan Apaolaza Sancho - réfugié Basque de 36 ans et prisonnier politique - est en détention depuis plus de dix mois.



Ivan est accusé d'avoir appartenu à l'ETA (une organisation nationaliste
armée Basque), accusation qu'il nie entièrement. Sur la base de simples
allégations provenant du gouvernmenet espagnol, il demeure en détention
à Rivière des Prairies, et ce, depuis Juin 2007. Aucune preuve n'a été
soumise pour soutenir ces allégations. De plus, toutes les allégations avancées
par les autorités espagnoles semblent provenir d'une déclaration faite sous la
torture (voir ci-dessous). Si le Commissaire de la Commission de
l'Immigration et du Statut de Réfugié (CISR) accepte ces allégations, Ivan
fera face à la déportation vers l'Espagne, ou il s'attend à plus de
détention arbitraire et à un risque de torture.

Ivan fait partie des centaines de prisonnierEs politiques Basques, détenuEs
selon la volonté des autorités espagnoles, avec la complicité d'autres
États, comme le Canada. L'État espagnol inflige aux mouvements
souverainistes de gauche Basques une répression intense et cruelle (qui
touche tous les secteurs de la société Basque, notamment les organisations
de la société civile, les médias et les groupes politiques), et ce depuis
des siècles. Aujourd'hui, suivant les traces du régime franquiste, la
répression politique continue de tenter de désintégrer la base populaire de
soutien au mouvement Basque. Des 18 721 personnes arrêtées au pays Basque
pour des raisons politiques entre 1977 et 2002, 9200 ont été emprisonnées,
5300 ont rapporté avoir été torturées, et 9 personnes
ont été assassinées pendant des interrogatoires de police.

Le 24 Mars dernier, le comité de soutien d'Ivan a organisé une
conférence de presse afin d'annoncer que toutes les allégations qui pèsent
contre Ivan proviennent d'une déclaration faite par une militante Basque, obtenue sous
la torture alors qu'elle était en détention Incommunicado. Le comité de
soutien d'Ivan et ses avocats ont demandé à Stockwell Day de le relâcher
immédiatement et d'arrêter d'être complice de la torture.

Le jour suivant, lors d'une audience de la CISR, les avocats d'Ivan ont
exigé que le dossier qui pèse contre lui soit annulé étant donnée l'absence
totale de preuves et étant donnée l'évidence que les allegations
avancées proviennent d'informations obtenues sous la torture, ce qui est
non recevable devant un cour de droit canadien ou international. L'expert
juriste Didier Rouget a témoigné que le Canada pourrait être en train d'enfreindre le droit
international s'il déportait Ivan sur cette base. Les audiences reprennent
le 25 Avril.

Dans l'intervalle, Ivan a été soumis à une autre audience de révision de
détention. Juste deux jours avant la Journée des Prisonniers Politiques, le
Commissaire de la CISR a eu l'opportunité d'arrêter de se rendre complice
de la torture et de la répression - opportunité qu'il n'a pas saisie.

« Dans le cas de M. Ivan Apaolaza Sancho, l'interdiction de territoire
prononcée par les autorités canadiennes se fonde sur des accusations
d'appartenance à une organisation terroriste, soit l'ETA, qui n'ont jamais
été jugées par un tribunal. De plus, ces accusations portées par l'Espagne
sont basées sur des allégations qui auraient été obtenues sous la torture,
selon les informations qui nous ont été transmises par l'avocat de Monsieur
Apaolaza Sancho. Le Canada a ratifié la Convention contre la torture et
autres peines ou traitements cruels, inhumains et dégradants. En vertu
de l'article 15 de la convention, aucune preuve ne peut être considérée
comme valide lorsqu'elle est obtenue sous la torture. ... S'il est renvoyé en
Espagne, M. Apaolaza Sancho court un important risque de subir la

demandait en janvier 2008 une enquête à l'égard du comportement des forces

Ce documentaire d'une heure rassemble les sons, musiques et voix
provenants de divers mouvements de personnes sans-papiers à travers la France. Le président français Nicolas Sarkozy et son ministre de l'immigration, Brice Hortefeux, ont fixé pour la fin de 2008 un objectif de 25 000 expulsions du pays. La France a mis en branle une machine à expulser, avec pour conséquence qu'il ne reste que quelques espaces de liberté et de relative sécurité pour les 400 000 sans-papiers du pays. Des actions policières massives, qui visent à arrêter et expulser le plus grand nombre de sans-papiers possible, ont envahi des écoles, des foyers, des stations de métros et des lieux de travail. Nous avons visité quelques uns de ces lieux, pour en ramener les voix de ceux et celles qui résistent.

As part of a National Day of Action for immigrant rights, Solidarity Across Borders is again taking to the streets, with our allies, to demand justice and dignity for all migrants. In opposition to deportations and detentions, we demand STATUS FOR ALL! There is no such thing as an "illegal" human being, only illegitimate laws and governments.

Daily, we resist deportations and detentions, we fight for justice in the workplace, we demand safe and secure housing, and we oppose racism and racial profiling. In contrast to the xenophobia promoted by the false "reasonable accommodation" debate in Quebec, we take to the streets to celebrate our collective struggles for justice and dignity in all its diversity and strength.

This year, we march through the streets of Cote-des-Neiges, a predominantly poor, working class and immigrant neighbourhood. Our march will mark the culmination of "Mayworks!", a festival of working class and immigrant culture, organized by the Immigrant Workers Center (IWC). Our march is also part of the Mayday tradition, as we celebrate the struggles of working people locally and throughout the world.

Après plus d’une année de consultation à travers le Québec, la Commission pour l’avenir de l’agriculture et l’agroalimentaire (CAAAQ) a déposé son rapport en février. Ce rapport remet en question le modèle d’agriculture que l’État québécois privilégie et le gouvernement semble vouloir le reléguer à un fond de tiroir. Profitons du dépôt du rapport pour nous faire entendre et ne laissons pas les propositions issues de la passer sous silence!

Que fait notre gouvernement par rapport à l’agriculture ? Les politiques agricoles en place au Québec sont basés sur une vision industrielle de l’agriculture. Plutôt que d’aider les communautés locales à développer une agriculture écologique répondant à leurs besoins, elles servent les intérêts des grandes corporations qui n’ont aucun respect pour la terre et les vies humaines. Partout sur la planète, ce modèle d’agriculture brime le droit à l’autodétermination des peuples et des collectivités. Partout aussi, une résistance se forme pour défendre le droit à la terre et la liberté. Au Mexique, les zapatistes se sont opposés à la signature de l’ALENA qui niait leur droit à posséder la terre collectivement. En Inde, en Amérique du Sud et en Europe, des groupes se sont formés pour détruire des champs d’OGM.

Alors qu’il en a l’occasion suite au rapport de la CAAAQ, le gouvernement québécois refuse de revoir le modèle d’agriculture qu’il préconise. Pourtant il ne fait aucun doute que l’agriculture est en crise écologique, sociale et économique. La concentration des fermes est de plus en plus importantes, les cours d’eau sont en piètres états et plus d’une région est traversée par des conflits notamment par rapport aux porcheries.

Bien que nous ne soyons pas dupes des manigances pseudo-démocratiques de nos gouvernements, nous croyons que le rapport de la CAAAQ contient un ensemble de recommandations bénéfiques pour l’agriculture.Dans cette perspective, nous demandons :

1. l’abolition du monopole syndical de l’UPA
2. la mise en place d’un financement public favorisant les petites fermes écologiques
3. l'interdiction de l’usage des OGM, des pesticides de synthèse et des hormones de croissances
4. le respect des droits et la justice pour tou-te-s les travailleuses et travailleurs migrant-e-s et la régularisation de toutes les personnes sans-status.

Nous reconnaissons par ailleurs que le Québec et le Canadasont basés sur le vol de la terre des communautés autochtones. Notre travailest en solidarité avec les luttes autochtones dans le cadre d’un mouvement global pour l’autodétermination des peuples et collectivités, ici commeailleurs.

After more than a year of consultations across Québec, “la Commission pour l’avenir de l’agriculture et l’agroalimentaire” (CAAAQ) released its report this February. The report confronts the actions and policies of the Quebec government regarding agriculture and suggests major changes. Since its release the government has refuted its recommendations and attempted to silence the serious concerns it raises. We will not let these concerns and recommendations go unheard!

What is our government doing in relation to agriculture? Quebec's current agricultural policies prioritize industrial practices. Instead of supporting local communities develop an agriculture that responds to their needs, these policies are designed to serve the interests of corporations, who have no respect for the earth or human life. Across the world, this model of agriculture has displaced entire communities and is undermining the basic self-determination of people. In the face of this reality, people all over the planet are engaging in resistance and fighting for their land and freedom. In Mexico, the Zapatistas continue to show their opposition the NAFTA (North American Free TradeAgreement), which favors large-scale industrial agriculture over the rights of communities to own and work land collectively. In India, South America and Europe, people have come together in protest, to destroy whole crops of genetically modified plants.

Despite the progressive recommendations of the CAAAQ the government continues to refuse reconsidering its current model of agriculture. This reaction comes, in spiteof the clear fact, that agriculture is experiencing an ecological, social andeconomic crisis. Some examples of this reality are: the marginalization of small farms by ever expanding industrial farms, the increasing pollution of rivers and lakes by toxic run-off from industrial farming and conflicts - most notably surrounding the issue of pigfarms – that are springing up in various regions.

Although, we are conscious of the illegitimacy of our pseudo-democratic government and its various arms, we do believe that the recommendations issued by the CAAAQ are helpful. In this light, we demand:

1. The abolition of the unionization monopoly held by UPA (AgriculturalProducers Union of Quebec).
2. A restructuring of agricultural subsidies, in favor of small-scale organic farms over large-scale industrial farms.
3. A ban on the use of GMOs, synthetic pesticides and growth hormones.
4. Respect for the rights of, and justice for all migrant workers as well as the full regularization of all on-status people.

We recognize that the lands we know as Quebec and Canada are stolen lands.
As part of a global movement for self-determination our work is rooted in support and solidarity with indigenous struggles. Land and freedom!

A Demonstration for justice, solidarity and ecology in agriculture

My name is Ivan Apaolaza Sancho, I am a graduate in sociology and my nationality is Basque. I have been detained at the Rivières-des-Prairies detention centre in Montreal since June 29th 2007 on the basis of an arrest warrant issued by the Spanish state (and with the help of Immigration Canada). This is a Spanish state that during all of my deportation proceedings has presented no evidence whatsoever against me, only accusations—accusation which I deny, a state that seeks my deportation based on the principle that accusations are evidence, and on an conception of justice founded not on the right to be presumed innocent until proven guilty but rather than one is guilty until innocence is proven.

In December of 2007, my lawyers filed a motion seeking the dismissal of the deportation proceedings against me in light of the total absence of evidence presented. Although the commissioner presiding over my case had initially agreed to do so, he refused to even rule on the motion after having received our arguments and those of the Minister.

If I am deported, I will be placed in the hands of the Spanish police or of the Civil Guard, both being forces with a sad record of torture, torture which has been denounced each year (including 2007) by Amnesty International, and which has been decried by the UN Special Rapporteur. For example, last week a young Basque named Igor Porto found himself in the intensive care until of the San Sebastien hospital with several broken ribs and a punctured lung after having passed through the hands of the Civil Guard.

The Spanish judicial system permits incommunicado detention in police custody for five days, without the right to a lawyer, to a trustworthy doctor or to communication with one’s family. The Anti-Terrorist Law that permits such detention clearly violates basic principles of international human rights law and has been denounced by the majority of parties and social movements in the Basque country.

The U.S. has its infamous PATRIOT Act, and in Spain there is the Anti-Terrorist Law and the Political Parties Law. These laws have permitted the closure of newspapers, the banning of political parties and the imprisonment of persons for the simple reason that that are Basque and pro-independence—laws which make you a member of the ETA when you don’t even know you’re a member, laws which allowed a judge to justify the closure of EGIN (the newspaper with the second largest circulation in the Basque country) by stating that “there is no lack of evidence to justice the shutdown of EGIN, all you have to do is read it”, laws which transform pro-independence Basques directly into terrorists, where people are not judged for their unlawful acts but for their ideas.

In response to this situation, the city council of my home town has passed resolutions asking Canada to grant me political asylum and to liberate me, and my neighbours in the Basque country have already gathered over 2,000 signatures on a petition with the same demands.

I will also take advantage of this opportunity to denounce the conditions that were imposed on my here in Rivières-des-Prairies. For six months, I was in the most restriction section of the prison, without the right to participate in any activities. I had only one hour a day in the courtyard, no gym, no studies, nothing. This is a regime where calling my family in the Basque country was a privilege not a right, where I was not permitted to embrace my family who had come to visit me all the way from the Basque country, and where it still takes two months for my mail to come through.

I have lived in Canada and in Quebec for almost seven years without having any problems, working as a carpenter. It’s true that I assumed another name in order to work and to live, but I did so out of fear of exactly what is happening to me now. Fully aware of what happened to Gorka Salazar Perea and Eduardo Plagaro Perez de Arrilucea, who were extradited to Spain in 2005 and who are still in prison for crimes they did not commit, I did not want to become another Basque political prisoner in Canada. That is what I am today.

All I ask is to be able to stay here, to live peacefully, without fear of reprisals from the Spanish government because I am Basque and pro-independence.

Je suis détenu au Centre de détention de Rivières-des-Prairies depuis le 20 juin 2007 en vertu d’un ordre d’arrestation de l’état espagnol (avec l’aide du Ministère de l’immigration du Canada). Un état espagnol qui durant tout mon processus de déportation n’a présenté aucune preuve contre moi, seulement les accusations—accusations que je nie. Un état qui cherche mon expulsion en se fondant sur le dire que des accusations sont des preuves, sur une idée de justice basée non sur le droit d’être innocent jusqu’as ce qu’on démontre le contraire sinon qu’on est coupable jusqu’à ce qu’on prouve son innocence.

En décembre 2007, mes avocats ont déposé une requête demandant le rejet des procédures de déportation à cause de l’absence totale de preuve. Bien que le commissaire en charge de mon cas ait accepté initialement de statuer sur la requête, après avoir reçu nos arguments et celles du Ministre, il a refusé de le faire.

Si je suis déporté, je serais remis entre les mains de la Police espagnole ou de la Garde Civile, des corps avec un triste parcours de torture, tortures qui sont dénoncées chaque année (l’année 2007 inclut) par Amnistie internationale, tortures que le Rapporteur Spécial de l’ONU a dénoncées. Comme exemple, la semaine passé un jeune basque, Igor Porto, s’est retrouvé à l’unité des soins intensifs de l’hôpital de San Sebastian avec plusieurs côtes cassées et un poumon perforé après avoir passé par les mains de la Garde Civile.

Le système judiciaire espagnol permet la détention incommunicado pour cinq jours aux mains de la police sans droit à l’avocat ni à un médecin de confiance ni de contacte avec la famille. Cette loi anti-terroriste viole clairement les principes de base du droit international en matière de droits de la personne et est dénoncée par la majorité des partis et des mouvements sociaux du pays Basque.

Les Etats-Unis a sa tristement célèbre PATRIOT Act, Duplessis avait sa Loi du Cadenas, Trudeau la Loi des Mesures de Guerre, et en Espagne il y a la loi anti-terroriste et la loi des partis politiques. Ces lois ont permis la fermeture de journaux, d’interdire des partis politiques et d’emprisonner des personnes pour le simple fait d’être des indépendantistes Basques, des lois qui te rendent membre de l’ETA sans que tu saches toi-même que t’es membre, des lois qui permettent à un juge de défendre la fermeture d’EGIN, le deuxième journal au pays Basque, en disant « que pour fermer EGIN il ne manque pas de preuve, il suffit de le lire », des lois qui transforment des indépendantistes Basques directement en terroristes, où on ne juge pas des personnes pour des actes délictuels sinon que pour des idées.

Face à cette situation, le conseil municipal de ma ville natale a passé des résolutions demande au Canada de m’octroyer l’asile politique et de me libérer et mes voisins au pays Basque ont déjà ramassé plus que 2,000 signatures sur une pétition avec les mêmes demandes.

Je profite aussi de cette opportunité pour dénoncer le régime de vie qui m’a été imposé à Rivières-des-Prairies pendant six mois. J’étais au secteur le plus restrictif au centre de détention, sans droit à aucune activité. Je n’ai eu qu’une heure à la cour par jour, aucun gymnase, aucun études, rien. Un régime où appeler ma famille au pays Basques n’était pas un droit sinon un privilège, un régime qui ne m’a pas permis d’embrasser mes parents qui sont venu me voir depuis l’Europe et où ça prend toujours deux mois avant de recevoir mon courrier.

J’ai vécu au Canada et au Québec pour presque sept ans sans avoir de problèmes, travaillant comme menuisier. C’est vrai que j’ai assumé un nom d’emprunt afin de vivre et travailler ici, mais j’ai dû le faire parce que je craignais précisément ce qui m’arrive actuellement. Bien au courrant de ce qui s’est passé à Gorka Salazar Perea et Eduardo Plagaro Perez de Arrilucea, qui ont été extradés en Espagne en 2005 et qui sont toujours en prison pour des crimes qu’ils n’ont pas commis, je ne voulais pas devenir un autre prisonnier politique Basque au Canada. C’est ce que je suis aujourd’hui.

Tout ce que je demande, c’est de pouvoir rester ici, pour vivre tranquille sans craindre les représailles du gouvernement espagnol parce que je suis Basque et indépendantiste.

-- La continuité des luttes contre les procès secrets et les certificats de sécurité --

En février dernier la nouvelle loi sur les certificats de sécurité du gouvernement canadien est entrée en vigueur afin de répondre à la précédente loi jugée inconstitutionnelle par la Cour Suprême. La nouvelle loi permet toujours l'emploi de preuves cachées et de procès secrets et ne change rien à l'injustice fondamentale du processus des certificats de sécurité qui permet la détention d'individus sur la base de soupçons, sans leur accorder leur droit à un procès juste et équitable et sans la possibilité de se défendre contre des allégations non prouvées.

Ce mois-ci dans notre émission, nous entendrons LATIFA CHARKAOUI, la mère d'Adil Charkaoui, qui a pris la parole lors de la journée internationale de la femme durant la conférence organisée le 1er mars dernier par le groupe Femmes de diverses origines. Dans son touchant message, elle parle de ce que vit et endure sa famille dans ce contexte de certificat de sécurité. Une situation qui a transformé les membres de la famille en prisonniers. Elle récite aussi « Le bracelet », le texte d'un dialogue imaginaire, rédigé par Adil Charkaoui pour expliquer à son fils ce qu'est le bracelet GPS qu'il est contraint de porter à sa cheville comme condition pour sa sortie de prison.

AUSSI nous vous présentons une interview exclusive avec ADIL CHARKAOUI qui est soumis à un certificat de sécurité depuis le mois de mai 2003 et surveillé par l'état depuis près d'une décennie. Dans cette interview, Adil parle de la nouvelle loi sur les certificats de sécurité, des avocats spéciaux, du défi légal que lui fait subir cette nouvelle loi, de ses conditions de « libération », des ses réactions face aux allégations sans preuve portée contre lui sur le site internet de la Cour fédéral, de l'utilisation des certificats de sécurité pour justifier la « guerre au terrorisme », et plus encore.

Dans notre émission du mois de mars et dans le cadre de la semaine contre le racisme, la campagne « Accommode donc ça » a organisé une série d'ateliers et de discussions et a élaboré un contre rapport à la Commission Bouchard-Taylor.
